Dubois County Prosecutor requests special prosecutor investigate commissary funds expenditures

Dubois County Prosecutor Beth Schroeder has filed a request with the Dubois Superior Court for a special prosecutor to investigate the allegations of the Dubois County Sheriff’s Office inappropriately spending commissary funds.

Under Indiana Code 33-39-10-2, various grounds exist for appointing a special prosecutor. In this case, subsection (b)(3) provides that a circuit or superior court judge may appoint a special prosecutor if: (A) the prosecuting attorney files a petition requesting the court to appoint a special prosecutor; and (B) the court finds that the appointment is necessary to avoid the appearance of impropriety.

“Given that Sheriff Kleinhelter and I are both elected officials in Dubois County, out of an abundance of caution and to avoid the appearance of impropriety, I have filed a petition requesting that an independent prosecutor be appointed to investigate the allegations,” Prosecutor Schroeder stated.

Prosecutor Schroeder made this request last Wednesday, July 31, 2024, and is currently awaiting the appointment of a special prosecutor.
